State contract rules
Buying a vehicle service contract in West Virginia
West Virginia Code 33-4-2 excludes defined service contracts from the insurance chapter. Its definition includes separately paid repair or replacement agreements and specified vehicle products. The exclusion depends on the product meeting the statutory definition.
A contract outside insurance regulation still has written obligations. Identify the provider, coverage, claim procedure and cancellation terms, and use the Attorney General's Consumer Protection Division for questions about deceptive business practices. Do not interpret this exemption as proof that every product marketed as an extended warranty is exempt insurance.
