Buying a vehicle service contract in North Dakota
North Dakota Century Code 26.1-40-18 requires an issuer of a written automobile warranty, mechanical breakdown contract or service contract to maintain insurance covering its contractual obligations. Original equipment manufacturers are exempt. The insurer must be licensed, registered or otherwise authorized in the state.
Ask the issuer to identify the backing insurer and explain how a claim reaches that insurer if needed. The Insurance Department provides consumer assistance and an insurance complaint process. This insurance-backing requirement does not establish a universal cancellation deadline or guarantee payment for an excluded repair.
