Buying a vehicle service contract in New York

A service contract provider must register with DFS and meet Article 79's financial responsibility requirements through insurance, reserves and security, or qualifying net worth. Identify the provider, administrator and seller separately.

The original purchaser has at least 20 days from mailing, or 10 days when the contract is delivered at sale, to return it for a full refund if no claim was made. A contract may allow longer. A refund delayed more than 30 days after return carries a 10% monthly penalty. Later cancellation depends on the contract's stated terms.

Do not treat New York's provider-fee filings as a public price list for all mechanical breakdown contracts. The filing requirement in §7903(a) applies to the windshield-chip and paintless-dent repair contracts defined in §7902(k)(2) and (3).
